A DEVELOPMENT of up to 49 homes in a village has been given the all-clear by a Government inspector.
The outline application for the site, south of Frinton Road, in Thorpe, was originally refused by Tendring Council in November last year.
But Eamon Ryan, of Drury Investments, appealed the decision in a bid to get it overturned and has been successful.
Tendring Council had argued the proposed development would not preserve or enhance the village’s conservation area and said it would have a negative effect on a Grade II registered park and garden.
The council also argued it had a five-year supply of housing land.
But on the first day of the two-day inquiry, another Government inspector allowed an appeal for a development in Sladburys Lane, Clacton, stating the council did not have the five year supply identified.
As a result of the Sladburys Lane appeal decision, the council’s evidence on housing land supply had to be withdrawn from the public inquiry.
Inspector Cullum Parker subsequently allowed the appeal, saying: “I have found that the proposal would accord with the policies of the development plan in respect of the impact on heritage assets and local biodiversity.”
